2. Acceptance, Modification, and Updates

By utilizing the Platform, you affirm that you are legally capable of entering binding contracts and agree to the unamended terms set forth herein, as well as our incorporated Privacy Policy. Beyond Career expressly reserves, at its sole and unfettered discretion, the right to modify, amend, supplement, or entirely replace these Terms at any time, with or without prior notice. All amendments, updates, or revisions will be published on the Platform with a clearly stated effective date. Your continued access or use of the Platform after such changes will be construed as your full acceptance and agreement to the modified Terms. You bear full responsibility for regularly reviewing these Terms to remain informed of any changes.

3. Eligibility and User Representation

You represent and warrant that you are at least sixteen (16) years of age—or such other legal adult age as mandated by your jurisdiction—to enter into binding agreements and to lawfully utilize the Platform. You further agree to provide complete, accurate, and current information during any registration or account setup process, and to promptly update such information to maintain its accuracy. Failure to do so constitutes a material breach that may result in immediate suspension or termination of access at our sole discretion. Beyond Career retains the unrestricted right to deny service, restrict, suspend, or terminate your Platform access for any violation or suspected violation of these Terms or for any lawful reason, without notice or liability.

4. Registration, Access Credentials, and Security

Certain features and functionalities of the Platform—including but not limited to job applications, event registrations, resource saving/bookmarking, profile management, and communication tools—require you to register an account ("User Account"). You are solely responsible and liable for maintaining the confidentiality and security of your login credentials, including your username and password. Sharing your credentials or account access with any other person or entity is strictly prohibited.

You must notify Beyond Career immediately upon any actual or suspected unauthorized use of your account or breach of security. Beyond Career disclaims all liability for any direct or indirect loss or damage arising from your failure to keep your account credentials secure or from unauthorized access through your credentials. Furthermore, you agree to indemnify and hold Beyond Career harmless from all claims, damages, liabilities, and expenses arising due to any breach of account security attributable to your negligence.

5. Description of Services

Beyond Career is an online platform providing services such as access to educational and career resources, job and internship opportunity listings with application management, event discovery and registration, community engagement facilitated through third-party channels, content management features for authorized users, and communication and support tools. These services are provided “AS IS” and “AS AVAILABLE” without warranty or guarantee of uninterrupted or error-free operation. We disclaim all liabilities for delays, failures, or inaccuracies relating to Platform availability or content.

6. User Conduct and Acceptable Use

By using the Platform, you agree to comply fully with applicable laws, regulations, and these Terms, and further agree not to:

• Engage in activities that are fraudulent, unlawful, offensive, abusive, threatening, harmful, defamatory, or infringe on others’ rights.
• Post, upload, transmit, or distribute any content or material that is obscene, indecent, hateful, or otherwise objectionable.
• Introduce or distribute malicious code including viruses, worms, spyware, or Trojan horses designed to impair the Platform or users’ devices.
• Attempt unauthorized access to the Platform, its systems, data, or other user accounts via hacking, password mining, or other illicit means.
• Deploy automated scraping tools, bots, or robots without explicit written consent from Beyond Career.
• Impersonate any entity or misrepresent affiliation with the Company or other third parties.
• Copy, reproduce, sell, trade, distribute, or exploit any portion of the Platform’s content without our express prior written permission.

Beyond Career reserves the absolute right, in its sole and unfettered discretion, to monitor user activity, remove or disable access to content, suspend or terminate user accounts, and pursue any lawful remedies upon violation or suspicion of violations of these provisions.

7. Intellectual Property Rights

All intellectual property rights in and to the Platform’s software, content, trademarks, logos, interfaces, designs, and documentation are exclusively owned by Beyond Career, its licensors, or affiliates and are protected by applicable copyright, trademark, patent, and other laws. You shall not copy, modify, reproduce, publish, create derivative works from, transmit, display, distribute, license, sublicense, or exploit any Platform materials without explicit written consent from Beyond Career.

Any content you submit or upload (including but not limited to resumes, communications, user-generated content) grants Beyond Career a perpetual, irrevocable, royalty-free, worldwide, transferable, and sublicensable license to use, reproduce, adapt, modify, publish, distribute, translate, and publicly display such content solely for purposes related to the operation, promotion, or improvement of the Platform.

8. Third-Party Services, Listings, and Content

The Platform may include integration with or links to third-party services, employers, event organizers, or community groups (including but not limited to WhatsApp). Beyond Career neither controls nor guarantees the accuracy, legality, suitability, or quality of any third-party content, products, or services. Any interactions, contracts, or transactions entered into with third parties are completely independent of Beyond Career. You acknowledge that using such third-party services is at your own risk and that we bear no responsibility or liability for disputes, losses, or damages arising from those interactions or the behavior of third parties.

9. Payment Terms, Refunds, and Fees

Although most Platform services are currently free, Beyond Career reserves the unilateral right to introduce, amend, or discontinue fee-based or premium services at any time without prior notice. Payment for such services shall be made via authorized payment channels as stipulated during the transaction process and will be subject to the payment processor’s terms. Beyond Career disclaims responsibility for any payment processing delays, errors, or disputes. All payments are non-refundable and non-transferable unless expressly stated otherwise or mandated by applicable law, and any refund decisions remain at the sole discretion of the Company.

10. Termination, Suspension, and Modifications of Services

Beyond Career retains absolute discretion, without liability or notice, to suspend, restrict, modify, or terminate your access to all or specific parts of the Platform for any reason, including but not limited to breaches of these Terms, inactivity, operational or security concerns, or lawful requests. Upon termination, all licenses and rights granted to you under these Terms shall cease immediately. Provisions relating to intellectual property, indemnification, limitation of liability, and governing law shall survive termination.

11. Data Privacy

Your privacy and personal data usage are governed by the Beyond Career Privacy Policy, which is incorporated into these Terms by reference. Use of the Platform constitutes acceptance of the Privacy Policy in its entirety.

12. Disclaimers and Limitation of Liability

The platform and all services are offered “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or title. Beyond career does not guarantee uninterrupted, error-free, or secure platform operation.

In no event shall beyond career, its affiliates, officers, employees, agents, or partners be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, loss of profits, revenue, data, or goodwill, or any damages whatsoever arising out of or related to your use or inability to use the platform, whether based on contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.

The maximum aggregate liability of beyond career for any claim shall not exceed the amount you have paid to the company in the preceding twelve (12) months, if any.

You agree to indemnify, defend, and hold harmless beyond career from any claims arising from your misuse of the platform, violation of these terms, or infringement of any third-party rights.

13. Indemnification

You agree to assume full responsibility and indemnify, defend, and hold harmless Beyond Career, including its officers, directors, employees, agents, partners, and affiliates, from and against any and all liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your use of the Platform, or any claims asserting infringement or violation of third-party rights caused by your actions.

14. Governing Law, Jurisdiction, and Dispute Resolution

These Terms, their interpretation, and any controversy or claim arising out of or relating to them or your use of the Platform shall be governed by and construed exclusively in accordance with the laws of the jurisdiction where Beyond Career is incorporated. You expressly consent to the exclusive jurisdiction and venue of the competent courts located therein for the resolution of any dispute or claim. Beyond Career expressly reserves the right to seek injunctive or other equitable relief in any jurisdiction, as necessary to enforce its rights and obligations.

15. Severability and Entire Agreement

If any term or provision contained in these Terms is held to be invalid, illegal, void, or unenforceable by any court of competent jurisdiction, the offending provision shall be severed and the remainder of the Terms shall remain in full force and effect. These Terms constitute the entire agreement and understanding between you and Beyond Career regarding the Platform and supersede all prior or contemporaneous oral or written agreements or communications pertaining thereto. No waiver of any Term shall be deemed a waiver of any other or subsequent breach. You may not assign these Terms without prior written consent from Beyond Career.

By accessing or continuing to use Beyond Career, you acknowledge that you have read, understand, and agree to comply fully with these Terms and Conditions, and agree that any ambiguity shall be resolved in favor of Beyond Career. Non-compliance with these Terms may result in suspension, restriction, or termination of your access without liability to the Company.
